1. Who we are

MagRec is operated by NINGYAO US LLC (“NINGYAO”, “we”, “us”, “our”). This Privacy Policy explains what information we collect when you use the MagRec device, mobile and desktop applications, and the heymagrec.com website (the “Services”), how we use it, and your rights.

2. Information we collect

2.1 You give us directly

• Account details (name, email, billing address).
• Payment information processed by our payment partner; we never store full card numbers.
• Support communications and any content you choose to send us.

2.2 Generated through your use of the Services

• Audio recordings made by the MagRec device. Recordings are stored locally on your device until you choose to process them.
• Transcripts, translations, summaries, and other AI outputs you produce.
• Diagnostic data: device firmware version, app version, crash logs, anonymous usage analytics.

2.3 From third parties

• Your AI processing requests are routed through model providers (including OpenAI). Audio sent for transcription/translation is transmitted over an encrypted connection.

3. How we use information

• To provide the recording, transcription, translation, and summarization features you request.
• To process payments and fulfill Kickstarter rewards or pre-orders.
• To send service notifications and respond to support requests.
• To improve product reliability and security (using aggregated, de-identified data where possible).

4. AI processing and content

MagRec uses third-party AI models, including ChatGPT-class large language models, to transcribe, translate, and summarize audio. Your audio is transmitted to these providers only when you initiate an AI action. We do not use your recordings, transcripts, or summaries to train AI models. We do not generate content on your behalf without your explicit instruction.

5. Data retention

Recordings remain on your MagRec device until you delete them or remove the device. Cloud-side audio sent for AI processing is deleted from our servers after processing completes. Transcripts and summaries sync to devices you sign into; you may delete them at any time. Account and billing records are retained per applicable tax and accounting laws.

6. Sharing and disclosure

We share information only with service providers (payment processing, cloud hosting, AI model providers, email delivery, customer support tooling) bound by confidentiality and data-processing agreements. We disclose information to comply with valid legal process. We do not sell personal information.

7. Your rights

• Access, correct, or delete your personal information.
• Export your recordings, transcripts, and summaries in standard formats (MP3, WAV, TXT, DOCX, PDF, SRT).
• Object to or restrict certain processing.
• Withdraw consent where processing is based on consent.
• Lodge a complaint with a supervisory authority (for EU/UK residents) or with the relevant US state regulator (e.g. California Attorney General).

8. Security

We use end-to-end encryption for audio in transit to our AI processing pipeline, encrypted storage at rest for cloud-side data, and industry-standard access controls. No system is perfectly secure; please use a strong, unique password for your MagRec account.

9. International transfers

NINGYAO US LLC is established in the United States. If you are located in the EU, UK, or other regions with data-transfer restrictions, your information may be transferred to and processed in the United States under appropriate safeguards.
